Grade A Customary Court, Court 2, sitting at Mapo, Ibadan, Oyo State, has dissolved the six-year-old wedlock between a couple, Bolutife and Bridget, on the account of lack of love and care, denial of conjugal right, infidelity and desertion.
Bolutife, who brought the divorce suit against his wife, Bridget, stated that they held a traditional wedding and he paid her bride price.
Bolutife further said that he and Bridget lived together for only four months before she deserted him.
According to Bolutife, Bridget, without prior discussion, informed him of her intention of travelling abroad for four months.
Bolutife explained that despite his objections, she proceeded with the trip.
The plaintiff added that he had waited endlessly for the defendant’s return since she left home five years ago.
Bolutife, described the brief time they spent together in marriage as unhappy.
He explained that his wife constantly neglected his welfare and denied him the needed care and attention.
He also claimed that Bridget constantly denied him sex which caused a strain in their relationship.
Bolutife stated that he later heard reports of her promiscuous lifestyle abroad, which prompted him to seek the dissolution of their marriage.
Bridget was absent in court despite being duly served with the hearing notice.
Bolutife, in his evidence, said, “My wife and I got married in October 2020.
“We held a traditional wedding, and I paid her bride price.
“My hope of having a happy marriage was shattered from the outset of our union.
“My wife started misbehaving early in the marriage.
“She placed little value on our relationship and treated me with disregard.
“She paid no attention to me, and my welfare meant nothing to her.
“My wife hardly cooked for me and did not care if I went hungry.
“We never enjoyed each other’s company because she was always nagging and complaining.
“No matter what I did she was never satisfied.
“She constantly denied me sex, which caused a strain in our relationship.
“My wife, without discussing it with me beforehand, informed me she was travelling out and that she would be there for four months.
“I expressed my disapproval and refused to give my consent.
“But she still travelled in March 2021 and has not returned since then.
“It is obvious that she has deserted me.
“Our marriage only lasted four months because we have been living apart for the past four years.
“I have received several reports of my wife’s indecent lifestyle in abroad which caused me great pain.
“I contacted her parents and close friends, but their response was discouraging.
“Her parents did not support our marriage.
“I eventually decided to seek the dissolution of our marriage, and informed my wife of my decision, but she showed no concern.
“I, therefore, pray this honourable court to rule that we are no longer husband and wife.”
The court president, Mrs O.E Owoseni, delivering her judgment, stated that the couple indeed had a subsisting customary marriage, adding that the bride price was paid.
Owoseni further said that since the plaintiff sought divorce on the grounds that the defendant had lived apart from him for about five years without his consent or approval, the court was inclined to grant him the relief sought.
Ruling, Owoseni declared their union dissolved.
