Grade A Customary Court, Mapo, Ibadan, Oyo State, has ended the relationship between a couple, Salewa and Quadri on the accounts of lack of love and care, and irreconcilable differences.
Salewa stated that Quadri was promiscuous and always brought his lovers to their home.
She further said that he was violent and in the habit of beating and harming her any time she complained of his immoral lifestyle.
The plaintiff stated that she derived no joy in her marriage and thus prayed that their wedlock be dissolved.
She begged the court for custody of their children and also requested an order restraining her husband from threatening her and interfering with her private life.
Quadri pleaded not guilty to the allegations brought against him.
He agreed to divorce but refused that his wife had custody of their children.
Salewa in her evidence said: โMy husband and I did not have a customary marriage. We held introduction ceremony, but he did not pay my bride price.
โMy husband became cruel after I lost our first pregnancy. He accused me aborting the pregnancy and beat me to a pulp.
โHe never stopped being hostile and violent towards me since then. He would always find a fault in all that I did and beat me.
โOn many occasions he would hit me with any dangerous object within his reach and would leave me hurting.
โQuadri had always been unfaithful to me. He was in the habit of bringing his lovers to our home, not minding how I felt.
โI run a clinic in the same building we have our apartment and he would come there to destroy my equipment whenever we had a clash.
โI reported him at the police station after he had almost ruined me. He was asked to write an undertaking stating that he would desist from such practice.
โHe did, but failed to keep to his words. I later dragged him before the Family Court where he entered an agreement and pledged to be of a good behaviour.
โHe went back to his old ways after a few weeks.
โMy lord, I no longer want to stay married to my husband. He has succeeded in ruining my life.
โI pray that our wedlock be dissolved, our children handed over to me, and my husband be made responsible for their upkeep.
โI also request an order restricting him from threatening and interfering with my private life.โ
Quadri while responding said: โMy wife and I had a smooth relationship until I lost my job. Then she stopped loving and caring for me.
โAny time we had a misunderstanding she would abandon me and move to her clinic.
โShe went as far as reporting me at the police station after we had a misunderstanding which resulted into a brawl.
โMy lord, my wife turned a harlot and was sleeping around. My ears were filled with details of her escapades.
โShe packed her belongings and left my house after I confronted her with facts of her illicit affairs with other men.
โMy lord, I agree that our marriage be dissolved, but I refuse that she has custody of our children.โ
The court president, Mrs S.M. Akintayo, ruling stated that there was no marriage to be dissolved because no customary marriage held between both of them and no bride price was paid.
Akintayo gave custody of their children to the plaintiff and mandated the defendant to be responsible for their upkeep.
She further gave an order restraining the defendant from threatening and interfering with the plaintiffโs private life.
