A 22-year-old woman in Spain has been fired for repeatedly arriving at work 40 minutes early, despite two years of warnings from her employer to stop clocking in before her permitted start time.
The employee, who was scheduled to begin work at 7:30 a.m., consistently showed up between 6:45 a.m. and 7 a.m., even after being expressly told she was not allowed to start or log in before her shift.
Managers said her persistent early arrivals left her with nothing to do and amounted to a refusal to follow basic workplace rules.
Her employer eventually dismissed her for serious misconduct, arguing that her behaviour demonstrated disobedience rather than dedication. The worker challenged the decision at the Social Court of Alicante, insisting the dismissal was unfair.
However, judges heard that she had ignored multiple verbal and written warnings and arrived too early on at least 19 documented occasions. On some days, she even attempted to clock in through the company’s mobile app before entering the office.
The company further accused her of selling a used company car battery without authorisation, a move the court said reinforced a “breach of trust.”
In its ruling, the court upheld her dismissal, stressing that the problem was not “excessive punctuality” but a repeated refusal to comply with workplace rules — a serious violation under Article 54 of the Spanish Workers’ Statute.
The worker still has the option to appeal to the Supreme Court of Valencia, but for now, the judgment stands.
